The government on Monday invoked a rarely used provision under the law to issue a gazette notification to restrict controversial preacher Zakir Naik's NGO from receiving foreign funds.
The notification, issued by the Ministry of Home Affairs, said Naik's Islamic Research Foundation (IRF) has violated provisions of Foreign Contribution Regulations Act (FCRA) and it should obtain prior permission from the central government before accepting any donation from abroad.
Official sources said the notification under Section 11(3) of the FCRA 2010 has been invoked in a rare case, though it can de done through an official order. The Section 11(3) deals with the issuance of gazette notification related to prior permission category.
"The Central government, in exercise of powers conferred under section 11 (3) (I) of said Act, hereby directs that IRF shall hereinafter obtain prior permission of the Central government before accepting any foreign contribution, until further orders," the notification said.
Sources had on Friday said the NGO was put under prior permission category.
The action comes two weeks after the Ministry of Home Affairs (MHA) renewed IRF's licence to collect foreign funds in a goof-up amid the ongoing investigations.
The MHA had conducted a preliminary inquiry in which it was found that the NGO was carrying out activities contrary to the FCRA and irregularities in its account books.
According to the norms, now the Reserve Bank of India will have to first inform the home ministry about the funds coming to the NGO and permission has to be taken from the ministry before releasing them to IRF.
